01 Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Changsha Lingjie Auto Sales Co., Ltd. ("Company", "we", "us", or "our"), concerning your access to and use of our services.
You agree that by accessing our services, you have read, understood, and agreed to be bound by all of these Terms of Service. If you do not agree with all of these terms, then you are expressly prohibited from using our services and you must discontinue use immediately.
02 Business Scope
Changsha Lingjie Auto Sales Co., Ltd. specializes in used car export services from China, serving overseas importers, dealers, wholesalers, and trading companies in target markets including Central Asia, Middle East, Africa, Latin America, and Southeast Asia.
Our services include:
- Used vehicle sourcing and procurement from Chinese markets
- Vehicle condition verification and documentation
- Export documentation and customs coordination
- Container loading, booking, and logistics tracking
- EV and hybrid vehicle export support
- Long-term supply chain partnership development
03 Service Conditions & Eligibility
Our services are intended for B2B commercial entities engaged in international vehicle trade. By using our services, you represent and warrant that:
- You are a legal business entity with proper registration and authorization to conduct international vehicle import/export operations
- You have the legal capacity and authority to enter into these Terms of Service
- You will comply with all applicable laws and regulations in your jurisdiction regarding vehicle imports, customs, safety standards, and emissions requirements
- All information provided to us regarding your business, shipment destinations, and intended use is accurate and complete
04 Vehicle Information & Condition
We strive to provide accurate and comprehensive vehicle information, including condition reports, mileage, specifications, and documentation. However:
- All vehicles are used and sold "as-is" unless otherwise explicitly stated in writing
- Vehicle condition information is based on available data and visual inspection at the time of sourcing
- We recommend buyers conduct their own due diligence and inspection when possible
- Buyers are responsible for ensuring vehicles meet their local market requirements and regulations
- Minor variations in condition, accessories, or specifications may occur and do not constitute grounds for refusal unless previously agreed in writing
05 Pricing & Payment Terms
All pricing is quoted in USD unless otherwise specified and is subject to the following conditions:
- Prices are based on current market conditions and may fluctuate
- Quotations are valid for the period specified; prices may be adjusted for delayed orders
- Payment terms will be agreed upon in the sales contract (typically T/T, L/C, or agreed milestone payments)
- Deposit requirements apply for order confirmation and vehicle reservation
- Final payment must be received before shipment release
- Currency exchange rate fluctuations are the responsibility of the buyer
06 Export & Logistics
We coordinate export documentation, container loading, and shipping arrangements. The following terms apply:
- We provide assistance with export documentation but buyers are responsible for ensuring documents meet their country's import requirements
- Shipping terms (FOB, CIF, etc.) will be specified in the sales contract
- We coordinate with freight forwarders but are not responsible for delays caused by shipping lines, port congestion, or force majeure events
- Risk of loss or damage transfers according to agreed Incoterms
- Buyers are responsible for customs clearance, duties, taxes, and compliance in the destination country
07 Limitation of Liability
To the maximum extent permitted by law, Changsha Lingjie Auto Sales Co., Ltd. shall not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Delays or failures caused by third parties, including shipping carriers, customs authorities, or government agencies
- Changes in import regulations, tariffs, or trade policies in destination countries
- Vehicle depreciation or market value changes after order placement
Our total liability shall not exceed the value of the specific transaction in dispute.
08 Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms of Service:
- Parties agree to first attempt resolution through good-faith negotiation
- If negotiation fails, disputes shall be submitted to arbitration in accordance with Chinese arbitration law
- The arbitration shall take place in Changsha, Hunan, China
- These Terms shall be governed by the laws of the People's Republic of China
- All communications during dispute resolution shall be in English or Chinese with appropriate translation
09 Modifications to Terms
We reserve the right to modify or replace these Terms of Service at any time at our sole discretion. Changes will be effective immediately upon posting to our website or upon notification to clients.
Your continued use of our services after any such changes constitutes acceptance of the new Terms of Service. It is your responsibility to review these terms periodically for updates.
For existing contracts, modifications will apply to future orders unless otherwise agreed in writing.
